Welcome to Cred Trace. These Terms of Service ("Terms") govern your access to and use of the Cred Trace website, APIs, automated bank statement analyser, and related financial credit intelligence tools (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By utilizing Cred Trace, whether as an individual customer, enterprise user, lender, chartered accountant, or NBFC partner, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Description of Service

Cred Trace is an automated credit intelligence and financial analysis platform. We provide tools to convert raw financial documents (including but not limited to bank statements in PDF, scanned image, or data formats) into structured transaction data, perform cash flow analysis, identify recurring income/EMI obligations, and flag potential anomalies or document tampering indicators.

3. User Account and Responsibilities

To access certain features of the platform, you may be required to register for an account or obtain API credentials. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your password, account tokens, or API credentials.
  • Notify us immediately of any unauthorized use or security breaches concerning your account.

4. Document Uploads & Authorization Consent

Because our platform parses and evaluates sensitive financial documents, you are subject to the following rules:

  • Consents and Rights: You represent, warrant, and covenant that you possess all necessary lawful permissions, user consents, and legal authorization to upload and process any bank statements, financial documents, or personal data belonging to third-party individuals (e.g., loan applicants or borrowers).
  • Compliance with Laws: You agree that your use of the Services will comply with all applicable local, national, and international data protection and financial privacy regulations.
  • Indemnification: You agree to hold harmless and indemnify Cred Trace against any claims, losses, or legal liabilities arising from the unauthorized upload of third-party documents.

5. Prohibited Uses

You agree not to engage in any of the following prohibited activities:

  1. Uploading false, simulated, or modified bank statements with malicious intent to circumvent normal underwriting processes (except for authorized sandboxed testing with synthetic data).
  2. Reverse engineering, decompiling, or attempting to extract the underlying source code, algorithms, parsing rules, or fraud detection logic of the Cred Trace engine.
  3. Using automated scrapers, bots, or extraction methods that bypass our system security controls or rate limits.
  4. Uploading files containing malware, viruses, or code designed to interfere with system operation.

6. Intellectual Property Rights

All rights, titles, and interests in the Cred Trace website, software, visual interfaces, dashboard layouts, icons, algorithms, databases, logos, and reports (excluding raw user-submitted documents) are and will remain the exclusive property of Cred Trace and its licensors.

7. Disclaimers & Financial Decisions

Please read the following disclaimer carefully:

  • Analytical Tools Only: The metrics, credit scoring aids (such as the CredTrace score), transaction categorizations, and fraud tampering alerts generated by the platform are analytical data points. They are provided on an "as is" and "as available" basis.
  • No Credit Advice: Cred Trace is not a credit bureau, credit institution, or licensed financial advisor. The reports do not constitute credit advice, loan approval recommendations, or financial endorsement.
  • Lender Discretion: All lending decisions, risk evaluations, and credit underwriting actions remain the sole responsibility and risk of the user or lender. Cred Trace is not liable for any financial losses or credit write-offs resulting from decisions made using our analysis.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Cred Trace, its affiliates, directors, or employees be liable for any indirect, special, incidental, punitive, or consequential damages (including loss of profits, revenue, or business data) arising out of or in connection with the use or performance of the Services.

9. Governing Law and Jurisdiction

These Terms and any disputes arising out of the Services shall be governed by and construed in accordance with the laws of India, without regard to conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts of India to resolve any legal matters arising from these Terms.
